SINGAPORE EFFECTIVE 1ST AUGUST 2014 ALL COMPANIES APPLYING FOR EMPLOYMENT PASS APPLICATIONS FOR FOREIGN WORKERS FIRST NEED TO GIVE ADVERTISEMENT FOR 14 DAYS BUT COMPANIES EMPLOYING 25 OR FEWER EMPLOYEES OR PAYING FIXED MONTHLY SALARY OF S$ 12000 OR MORE ARE EXEMPTED All companys seeking to file new Employment Pass applications on or after 1 August 2014 will be required observe new advertising regulations for vacant positions as established in the Ministry of Manpowers Fair Consideration Framework (FCF) and outlined in the recently distributed circular, The FCF will require employers submitting Employment Pass (EP) applications to advertise job vacancies on the national Jobs Bank. The advertisement must be open to Singaporeans and Permanent Residents, comply with the Tripartite Guideline on Fair Employment Practices, and run for 14 calendar days. Once the above requirements are met, the employer can then submit an EP application to the Ministry of Manpower (MOM) for approval. Exemptions from the advertising requirement are given to: Companies with 25 or fewer employees, or For positions paying a fixed monthly salary of S$12,000 or more For more details on the FCF, please refer to the MOM website. We understand from the MOM that Intra-Company Transfer (ICT) applications that meet existing criteria will be considered for exemption. Still, we are awaiting clarification from the MOM on ICT applications and the associated processes. It is important that employers sign up for a Jobs Bank account as soon as possible. To be eligible to submit an EP application on 1st August 2014, employers must begin advertising a vacant position on the Jobs Bank by 18th July 2014.
