SOME IMPORTANT ASPECTS OF SINDH ARMS ACT 2013 S. 23(1)A, Dose not attract if Pistol is recovered. as Pistol dose not fall under the definition of FIRE-ARM, S.24 may attract if Pistol is recovered as Pistol fall under the definition of ARM. Please also see Section 23(2), which provides 7 Years punishment in case accused/suspect is in possession of Pistol only but not used in commission of any offense. S.34(B), the concerned Police Station shell prosecute the offense where offense committed, CIA/CID/SIU etc. are not competent to lodge FIR. S.40(B), FSL report is mandatory if is positive if negative or delayed or not available this Act dose not applicable. NOTE. Arm Ord.1965 is still intact and has not been repealed. Under Art.143 Constitution of Pakistan, in case of inconsistency between federal laws and provincial laws, FEDERAL LAW shell preveal over provincial laws, therefore 13- d arm ord.1965 shell attract if Pistol is recovered .
