SUPREME COURT OF INDIA Read, Subscribe and Cite SUPREME LAWS TODAY (SLT) Daily Journal VI (2013) SLT 711 ANCESTRAL PROPERTY — Legality of Alienation — Release deeds, sale deeds and mutation entries made on that basis are illegal, null and void — Property acquired by defendant No. 2 father of appellant-plaintiff, on partition was ancestral property — Till birth of plaintiff he was sole surviving coparcener but the moment plaintiff was born, he got a share in father’s property and became coparcener. VI (2013) SLT 693 JURISDICTION — Jurisdiction is not attracted “by operation or creation of fortuitous circumstances”. VI (2013) SLT 693 JURISDICTION — Merely because child has been brought to India by appellant, custody issue concerning minor does not deserve to be gone into by Courts in India — It would be in accord with principles of comity as well as on facts to return child back to USA from where he is removed and enable parties to establish case before Courts in native States of child in USA. VI (2013) SLT 675 Delhi Gang Rape Case (16.12.2012) JUVENILE — In Juvenile Justice Act, 2000, a conscious decision was taken by Parliament to raise age of male juveniles/children to 18 years — No interference is necessary with provisions of Statute — Section 15(1)(g) as amended w.e.f. 2006 makes it clear that even if a juvenile attains age of 18 years within period of one year he would still have to undergo sentence of 3 years, which could spill beyond period of one year when he attained majority. VI (2013) SLT 770 INTERPRETATION OF STATUTES — Role of Preamble — Preamble cannot control scope of applicability of Act — It is statutory provision which will have to be read and analyzed for purpose of understanding scope and purport for which legislation was intended and brief statement contained in preamble will be of very little value. VI (2013) SLT 758 SERVICE LAW — Voluntary Retirement — Voluntary Retirement Scheme introduced by a company, does not entitle an employee as a matter of right to benefits of Scheme.
