School board approves one-year employee contracts, playing waiting game on offering four-year contracts At their regular monthly meeting on Monday, May 5, 2014, the Yancey County Board of Education approved personnel for continued employment in the 2014-15 school year for one-year contracts. (See list below). Because of new guidelines set forth by the General Assembly that eliminates career status for teachers, these school employees are no longer offered career contracts. In additional personnel action, the school board instructed Superintendent Tony Tipton to move forward with finalizing names of employees eligible for the four-year contract, which includes a pay raise implemented over four years in return for giving up career status (tenure). Tipton said he would wait until the short session of the General Assembly is complete to see if legislators make any changes to this requirement. The legislative session begins next week. Tipton said he and the board are “playing a waiting game” to see what the legislature does. “They could make changes or they could throw it out completely,” he said. “We are taking the steps we need to take until we see what happens in Raleigh.” Tipton said that if there are no changes, he anticipates having the list of employees accepting the offer at the June 2 board meeting. The school board will also act on administrator contract renewals at its next meeting. Currently, 37 Yancey County Schools employees have tenure and qualify to be offered the four-year contracts. The legislature mandated that contracts in exchange for tenure be offered to 25 percent of eligible employees. School boards in Guilford and Durham counties are suing the state over the new provisions to the law on teacher tenure. On April 23, a Superior Court Judge gave the two school systems a temporary injunction from having to offer contracts to teachers in exchange for tenure. It’s not clear yet whether that protection extends to other North Carolina school systems. The ruling on April 23 applies only to teachers who have career status or tenure. State legislators plan to eliminate tenure for teachers by 2018. The judge’s ruling gave the two counties protection from having to offer the four-year contracts in exchange for tenure and lasts until the courts resolve the issues outlined in the lawsuit, including concerns that revoking tenure from vested teachers violates the state and federal constitutions. This is just the first round in what could be a long court battle. State law gives North Carolina school districts until June 30 to select teachers and offer the contracts.
