Senator Tiffany and Rep Ballweg have written a new bill to restrict the power of local governments from imposing any restrictions on frac sand mines. Theyre circulating the newly drafted bill (LRB-3146/1 and LRB-3408/1 Relating to: Regulatory Certainty Act) and want co-sponsors by noon today. Please call your Assembly Rep & Senator, plus the mining committee members this morning and tell them to not sponsor this bill. We dont have frac sand mines in Marquette County yet. However frac sand mine is plentiful in this region and the active rail line running through Marquette County would make creating a profitable sand mine very easy to do. The nearest frac sand mine is in Green Lake County and which is Rep Ballweg district. The Green Lake County mine is owned by AF Gelhar. AF Gelhar has been trying to develop a new Frac Sand mine in the Town of Union in Waupaca County. The local residents have been fighting the mine because of it breaks their zoning code, it will be very near private homes (one home will be 160 Ft from the mine), the frequentcy large trucks on a rural road and the installation of a new high capacity well just down slope from a pristine ancient woodland. Ballweg and Tiffanys bill would take away all local powers to regulate the development of mines, and the use of explosives, trucks, etc. They call this adding certainty for mine developers. The only certainty for neighbors of frac sand mines is that their property values will drop a minimum of 25% immediately. Please read the article and call your legislators. The proposed bill restricts local governments’ authority over roads and traffic and the use of explosives, as well as their ability to regulate air or water quality related to nonmetallic mines.
