Senior Lawyer - São Paulo SP Advogado Sênior We are looking for a LAWYER for our office in São Paulo In your role, you will be responsible for supporting all contractual and legal requirements of rolling stock projects, services projects as well as other Division initiatives. Also, you will be responsible for leading the Project Core Team in the management of the commercial, contractual and claim aspects of Customer, Consortium/JV partner and supplier Contract(s). Main activities of this position to ensure the above mentioned missions are: As a Legal Advisor: - Define contractual and legal interpretation/analysis in rolling stock and services contracts in execution and provide practical solutions and guidance to the team members, including management. • Provide contractual and legal analysis and guidance in rolling stock and services responses to requests for proposal (RFP). • Prepare various agreements related to the Division activities, such as documents for real estate transactions (offers, leases, etc.), consulting agreements, confidentiality agreements, acquisition of material, etc. - Ensure application of Policies and Directives in which Contracts and Legal Affairs, as well as Commercial Management, are in lead or support. As a Project Commercial Manager: - Establishing and managing throughout the project lifecycle the contractual obligations towards and from the customer (and consortium partner). Provide training on the necessary commercial and contractual knowledge and skills to all Project Core Team members to enable them performing their scope of work. Make sure that obligation owners are assigned in the Project Core Team and that the Project Core Team is constantly aware of the obligations’ due dates. Ensures that lessons learned & best practices in commercial management are captured and made available for other projects and bids. - Participate in all Project Core Team, risk and opportunity, change control board and variation order meetings to ensure early identification of commercial risks and opportunities. Take ownership of all commercial and contractual risks and opportunities. Develop mitigation actions to manage commercial risks and develop enhancement actions to deliver opportunities. - Ensure contractual changes involving the customer, consortium partner, and supplier are properly notified in accordance with the contract and the BT Change Management process (e.g. issuance of notification/ variation order). Lead the management of Claims in accordance with the Claim Management process by devising effecting Claim preparation and negotiation strategies. Ensures that lessons learned & best practices in commercial management are captured and made available for other projects and bids. - Provide contractual and legal training to team members of other functions such as Bids, Sales, General Managers of sites and their team, Supply Management representatives. Provide and support training on commercial management aspects (e.g. chargeback process, claim management, change management) Qualifications As our ideal candidate you: - Hold a bachelor’s degree in Law; - Have experience in commercial management, including Claim management. - Have post graduate commercial qualifications. - Have a minimum of 04 years of experience in relevant roles - Have working experience with projects, ideally in similar business areas.
