Should ecosystems have legally enforceable rights? A global debate is in full swing – for example, the Constitution of Ecuador now recognises the rights of Nature. New Zealand gave “personhood” and legal standing to the Whanganui River in 2012 to help protect it - the decision was part of a settlement with several Maori tribes - guardians were appointed under a trust to act in the river’s interests – the river can now lodge an objection to a mining or hydroelectric dam proposal - initiate proceedings in the Land and Environment Court - and apply for a mandatory injunction requiring remediation of pollution or financial compensation.
