Silas Chepkeres Jakakimba ... Its great that the bail has been reduced and that R.H. Raila Odinga has paid for the same. This proves the doubting Thomases LIKE ME wrong, especially on his commitment to Dikembe Disembe and his comrades in arms. To this extent, I take an early opportunity to withdraw my Friday postîng, and to congratulate R.H. Odinga for showing that he can stand by his army and put his personal resources into their defence. Be that as it may, I still feel that, although bail is at the discretion of the Court, the amount payable should be openly discussed by the stakeholders in the Judicial system. I still feel that Kshs. 500,000.00 bail for a probably unemployed young person in unattainable, unless a third party comes in, like it has happened in this case. Otherwise bail orders will remain ineffective and not capable of being enforced, as most of the accused persons will never afford the same. Courts of Law should avoid giving orders in vein. And Court orders must not be seen as deliberately setting unattainable bail amounts to keep the caused persons incarcerated, as this will breach their fundamental right to liberty and freedom of movement. And lastly, I hope that Dikembe Disembes case is not the last, but actually the beginning of several law suits against hate speech. We hope that perpetrators of hates speech will be investigated and prosecuted in Court, based on credible evidence, irrespective of their ethnic, religious and political affiliations. There is so much hate speech going on in our rallies, TV screens, radio, and, especially social media. If it be the last, or is seen to be one of the select few, the Judiciary will not escape blame for being captured by the political class controlling the state to harass dissenting voices.
