Since yesterday I have been debating with colleagues and friends on exactly what the Deputy President can or can not do when acting as President like now. My argument which was opposed by some colleagues is that the DP can even sign into law, Bills passed in Parliament when the President is away. I even saw an argument by Prof Anyang Nyongo that the DP cant make some security decisions when the President is away and wondered how he arrived at that. My constitution (Article 134) has only 6 very clear and specific things which the DP CANT do meaning he/she can do all the others mandated to the President. 1. He/she cant nominate or appoint judges. 2. He/she cant nominate or appoint public officers who the const requires only the president to. 3. He/she cant nominate,appoint or dismiss cabinet secretaries or other state or public officers. 4. He/she cant apoint or nominate ambassadors or HCs. 5. Cant exercise power or mercy to convicts. 6. Cant confer honours in the name of the people or Republic. This means the DP can declare a state of emergency or even war when the President is away but subject the constitution. Correct me if am wrong. Finally, please, the ref to President and DP here is not Uhuru and Ruto unless you are a person if such small minds. You can even fill in the seats with you choice of President and deputy.
