So earlier this evening, I was wandering through the pharmacy at Winn-Dixie in Sebastian, where a friend works, and I noticed a fellow standing at the counter trying to sign his name electronically. He looked like he was in his late 30s or early 40s. He also looked shall we say intoxicated. Sedated perhaps, not drunk in particular. When the pharmacists stepped away I took the liberty of asking the man, who was not exactly hygienic, if he was driving. Fortunately, and to my relief, he said he was not. He said he had never learned to drive and in fact two times that he tried both times he got arrested. So heres the reason for the story: just like if a bartender serves another drink someone who is obviously inebriated and they get in an accident the bartender has culpability, is the same true for pharmacist, if the patient is obviously affected adversely by the medication. I suppose the staff could say we didnt know but I think its likely that video cams would pick up swaying, the staggering, and the ten seconds it took to sign his name on the electronic chalkboard. Any opinions on the legality? (as my friends know, I always have a snarky underlying agenda for asking questions like this.)
