Speaker of the Edo State House of Assembly, yesterday, declared the seat of the member representing Etsako West Constituency I, Mr. Abdulrazak Momoh, vacant for defecting to Peoples Democratic Party (PDP), from All Progressives Congress (APC). The Speaker, Mr. Uyi Igbe, during plenary of the APC lawmakers at the Old Assembly complex in Government House, Benin, said the lawmaker’s defection did not follow due process. According to him, section 109 (1g) of the 1999 Constitution as amended, empowers the Speaker to declare the seat of a lawmaker, upon defection to another party from the party he was elected, vacant. He called on the Independent National Electoral Commission (INEC) to fill the vacant position within 90 days. ============================================ If you recall it was this same question of vacating the seat when you change cloak that stopped the opposition from giving the ruling party a serious rap on the head via attempted impeachment of Mr President...The real question is this who owns the mandate...both parties have skillfully dodged this matter for months..much as i hate to quote the constitution...see section 14... 14. (1) The Federal Republic of Nigeria shall be a State based on the principles of democracy and social justice. (2) It is hereby, accordingly, declared that: (a) sovereignty belongs to the people of Nigeria from whom government through this Constitution derives all its powers and authority; >>>>> Its clearly stated that sovereignty belongs to the people..So if the mandate which is the grandson of sovereignty is lost and found ...who should be in custody? anyway lets see as this gets settled
