Summary of SB 42 The Safe Drinking Water, Water Quality & Flood Protection Act of 2014 Total Funding: $5.6 billion Safe Drinking Water- $1.5 billion • $500 million for emergency and urgent actions to ensure access to clean drinking water. • $1 Billion for Integrated Regional Water Management Plans (including recycling, groundwater clean-up, etc.). o Eligible projects must comply with policy to reduce reliance on the Delta. o Funding to be directed to direct reduction in demand from the Delta where feasible, also funding provisions to incentivize direct reductions in exported Delta water. Water Quality and Watershed Protection Projects- $1.8 billion • $400 million for wastewater treatment projects. • $900 million for water quality protection and watershed protection projects of statewide significance: o $600 million for Delta ecosystem restoration and community sustainability projects. Appropriated to the Delta Conservancy. Delta Conservancy must coordinate and collaborate with the city or county where the project is taking place. Funding cannot be used for eminent domain. Grantee must identify how the economic impacts (including ag impacts) will be assessed and mitigated. No matching funds required. o $300 million for water quality and watershed protection projects of statewide significance outside the Delta. • $500 million for regional watersheds (local conservancies). o Natural Resources Agency shall develop a statewide resources protection plan to identify priorities for watershed funding. The plan will direct the competitive granting of the $300 million for statewide and $500 million for regional conservancies. (No earmarks for conservancies.) Flood Control and Stormwater Management- $1.3 billion • $500 million for implementation of the Central Valley Flood Protection Plan. • $400 million for stormwater management. o Includes priority for projects reducing amount of imported water. • $400 million for Delta levees. o Eligible projects include subventions program, special projects program and levee upgrades/improvements to help levees withstand seismic events and sea level rise. • Water System Operation Improvements- $1 billion o Eligible projects include: Calfed Reservoirs (except Shasta). Groundwater storage and groundwater clean-up projects. Conjunctive use and reoperation projects. Projects that restore the capacity of existing dams (sediment removal). Projects that reduce demand on the Delta and result in a permanent transfer of water rights to CA Water Code 1707. Recycled water storage projects. o Provisions similar to existing bond, with a provision for specific benefits for the Delta. o No continuous appropriation. o Funding for mitigation prohibited. • Miscellaneous o Includes a savings clause for water rights, and for the Delta Reform Act. o Prohibits funding for construction, mitigation or operation of new conveyance. o Prohibits funding for mitigation or compliance obligations of any party.
