Supreme Court judgement on NEET needs to be immediately stayed sue-motto by Supreme Court itself New Chief Justice of India P Sathasivam should take sue-motto cognizance of wide-spread allegations about majority-decision part of Supreme Court’s split-verdict scrapping ‘National-Eligibility-cum-Entrance Examination’ (NEET) for seats in medical colleges being leaked much before its pronouncement at 10.30 am on 18.07.2013. There are also reports that the draft majority-judgement written by former Chief Justice of India was uploaded on a website weeks before its pronouncement on retirement-day of Justice Altamast Kabir. Otherwise also para two of dissent judgement by Justice Anil R Dave in 2-1 Supreme Court’s split verdict is enough to get the verdict immediately stayed by a new bench of Supreme Court to be immediately constituted sue-motto by Chief Justice of India without even requiring a review-petition being filed. ‘Justice hurried is justice buried’. It is highly improper that decision on such an important matter allowing private medical colleges to mint money through ‘donations’ and capitation-fees was announced without any consultations amongst bench-members because of paucity of time as clearly mentioned by dissenting Justice Anil R Dave. Since there is no authority other than Supreme Court itself which can probe leakage of its judgement prior to its announcement in the court, a fair and independent enquiry needs to be ordered by Chief Justice of India through country’s premier investigating agencies like Central Vigilance Commission and Central Bureau of Investigation. Such an unprecedented happening requires even judicial side of Judicial System also to be covered by RTI Act after pronouncement of judgements. As an interim measure, Union government should bring an immediate ordinance to undo Supreme Court verdict for safeguarding interests of un-affording but deserving students being denied opportunity to get admissions in private medical colleges because of their not being capable of paying huge amount to such education-shops.
