THE ABUSE OF LAW AND CONSTITUTION The withdrawal of tambuwal security men and threat from the PDP jonathaism to declare his seat vacant are totally lawless and have no regard to the constitution and the laws of the the federal republic of Nigeria, i wonder if there is any law or part of the constitution that state that the speaker of the house of representative must be from the ruling party or from members with the majority in the house. Hence, it is only the members of the house of representatives that has the right to remove a speaker by impeachment if they feel dissatisfied with the speaker or if the speaker loses his membership of the federal house of assembly. SPEAKER AMINU TAMBUWALS DEFECTION FROM PDP TO APC. MATTERS ARISING: Section 50 (1 b of the 1999 Constitution (as ammended) says: there shall be a Speaker and a Deputy speaker of the House of Representatives , who shall be elected from the members of that House, from among themselves. REMOVAL OF A SPEAKER Section 50(2) The Speaker of the House of Reps. shall vacate his office (a) if he ceases to be a member of the House of Reps. (b) when the House of which he was a member first sits after any desolution of that House; or (c) if he is removed from office by a resolution of the House of Reps., as the case may be, by votes of not less than two-thirds majority of the members of that House. Having read through the entire 1999 constitution, I didnt not see any clause that says the political party with the highest number of members in the House must produce the Speaker. I expected the PDP to take this development in good faith and move on but I was surprised to heard the National Secretary of the PDP Olisa Metu asking the Speaker to resign his position as the Speaker of the House. The question I asked myself was....RESIGN FOR WHAT??? Has he forgotten that what is good for the goose is good for the gander? Where was Olisa Metu when former Gov. Peter Obi decamped from (APGA) to PDP while he was governor for 8 years? Where was he when a sitting Governor Olusegun Mimiko decamped from Labour Party to PDP? Where was he when the Speaker of Ondo State House of Assembly decamped from LP to PDP? Now Speaker Aminu Waziri Tambuwal decamped from PDP to APC and he is being asked to resign honourably The PDP as it is today do not have the required two-third majority to unseat the Speaker. so in the interest of peace and way forward, they should accept the defection in good faith and move on, as any attempt to remove the Speaker of the House ofRepresentatives by any unconstitutional means will be firmly resisted by the Nigerian people. Moreso, the Mis-used of power by jonathan to intimidate, harass opposition party which against their constitutional right will surely suffer him in silence because power is like a grain of sand, the more you hold on to it, the more it loses your hand..
