THIS IS GOOD NEWS! Assuming the criteria in accepting the process of determining whether or not they will take this case is as described here (e.g. reasonable probability” that the Supreme Court will take this case and a “significant possibility” that the oyster farm will win... I am convinced there is more than a small likelihood that Drakes Bay Oyster Farm might just win this fight! The following is their email to supporters from today. Indeed, if this DOES go to the Supreme Court, there is a good chance that the lying and biased tactics employed in this case by the National Park Service and the Sierra Club, and all the sniveling by the eco-nazis who oppose this simple, bio-diverse and locally, not to mention nationally beneficial aquaculture business will backfire on those who wish to see this local employer and green-to-the-nines business destroyed. This company has been wronged so many times, by so many self-righteous. selfish and ignorant hosebags that no one could have faulted them for giving up this fight long ago. But they refuse to be pushed around by the powers-that-be! I say, GO DRAKES BAY OYSTER COMPANY!!! Whatever happens between now and when this is resolved, one thing is important: WHEN YOU BUY OYSTERS, BUY DRAKES BAY OYSTERS! If you dont support them, there are other great places out there to get them to, but show your support for the aquaculture in our area and our other wonderful local companies who provide us with such incredible products from our home ground. Buy Local! Eat Local! Spend Local! As much as you can... GO DRAKES BAY!!!!! January 28, 2014 Greetings, Drakes Bay Supporters, We are pleased to deliver some good news: The Ninth Circuit has granted our motion to remain in business while our legal team petitions the U.S. Supreme Court. In granting the stay, the court had to find that there is a “reasonable probability” that the Supreme Court will take this case and a “significant possibility” that the oyster farm will win. We are confident and hopeful! New video from PLF As we take this case to the Supreme Court, we’re going to need all the help we can get. One important supporter is the Pacific Legal Foundation, which will be filing a friend of the court brief on behalf of the California Cattlemen’s Association (whose members include many of the ranchers in Point Reyes) in support of our petition. Follow this link to watch a new video the PLF team created about the oyster farm and to read the PLF blog about our case. Where to find our oysters It will take at least several months for the Supreme Court to decide our case, and the oyster farm will remain open for regular hours that whole time. The oyster farm is open every day from 8:30 to 4:30. We look forward to seeing you! If you take photos of your visit, please post them on our Facebook page, or send them to us and we will post them for you. We love to hear your stories, too! You can also find Drakes Bay Oysters at fine restaurants throughout the San Francisco Bay Area. We have updated the availability page at our business website to make it easier to find our oysters—click here to visit the page. (It’s a good idea to call in advance, because not every restaurant has our oysters every day.) Drakes Bay Oysters are also available at the Marin Farmer’s Market (Thursdays and Sundays at the Marin Civic Center, 8 – 1) and some retail locations including G&G Market in Santa Rosa and Petaluma, Good Earth Natural Foods in Fairfax, Palace Market in Point Reyes Station, Sonoma Market in Sonoma, Martins Market in Windsor, and Vallarta Market in Calistoga. As always, thank you so much for your interest and support! Kevin & Nancy Lunny
