The ACLU of Indiana has challenged a recently-passed South Bend ordinance that regulates both publicly controlled and privately maintained social media accounts of council members. The ACLU filed the lawsuit on behalf of South Bend Common Council President Oliver Davis, claiming that the ordinance violates the First Amendment to the U.S. Constitution. Elected officials retain their First Amendment rights, said Ken Falk, ACLU of Indiana legal director. The ordinance simply goes too far in trying to impinge on these rights. Do you agree?
