The Building Regulations 2012 (and the Building Act 2011) Regulation 3 (Terms) state that a... private swimming pool means a place or premises, including a spa-pool but not a spa-bath, provided for the purpose of swimming, wading or like activities — (a) which the public are not entitled to use; and (b) which has the capacity to contain water that is more than 300 mm deep; A key legal argument is that a pond may not be principally used for swimming, wading or paddling. Accordingl6, Regulation 50 (enclosure of a private swimming pool) and other provisions of the Building Act 2011 will arguably not apply. A sign that reads; No Swimming, wading or paddling can keep the State Goverment from charging you for their onsite inspection of your pond (and other fees, levies and permit requirements). WARNING: Be prepared to have to write a letter and appeal to the States Administrative Tribunal as a first course of detensive action as it is often only a matter of time.
