The Eighth Amendment prohibits “cruel and unusual punishments.” The death row case in Missouri raises this peculiar question: Is there a constitutional way to execute Russell Bucklew? “There’s an issue about whether you can essentially plead and prove an Eighth Amendment claim without offering an alternative, feasible, constitutional means of your client being executed,” says Cheryl Pilate, an attorney for Bucklew. “At a more fundamental level, we think it’s unethical to compel an attorney to violate their ethics, to propose a means for the demise of their own client.”
