The Establishment does not have the right to disapprove or withhold petitions made by the people in response to Establishment abuses of power. Power protects itself. The government creating a board which checks the validity of petitions brought against it or its contemporaries is a kin to a murder suspect being placed in charge of the case. In the case of the petition to recall members of the Tawas City Council, Iosco County Election Commission is tasked to validate the Clarity of the Petition. First and foremost, the people of Tawas are the power in that City. They do not answer to the County government. In fact, it is the other way around. The County and the State which devised this law should be made to answer for the unethical manner in which the Board of Elections is established. The County Election Commission is made up of the County Treasurer, the County Clerk, and the Chief Judge of Probate. Why are not the people of the County represented? It stands to reason that individuals from among the people chosen to sit on this board would be as good a judges as to the Clarity of the petition in question. These people could be chosen at random as for Jury Duty. There ought to be three people selected to Even out the Board between the Establishment and the People. Ties should be called in favor of approving the petition. It must be remembered that the Petition must still be circulated and approved by a majority of the People before it is placed on a referendum for a vote by the People. The People ultimately are the arbiters of whether or not a Petition has enough clarity. Let their voices be heard. Government establishing Commissions to validate petitions against it is just plain wrong. This practice leads to exactly the kind of protectionism witnessed by the People of Tawas at the City Council meetings where the will of the People is subject to the desires and political gamesmanship of the City Council. Another related question must be raised; Is the County Commission or City Council subject to the same rules governing the submission of Proposals on the Ballot during Election Season?
