The FDA requires manufacturers to continually monitor the safety of their products and adjust their label warnings to reflect known risks. Generic drug manufacturers, however, have no such independent duty and cannot be held liable if they do not update their labels.... That is, unless, as this New Jersey court held, they do not update their labels once the original manufacturer does! Great decision.
