The Responsibilities of a Landlord Becoming a landlord is a major deal and no one can simply get up and think, “well, yes I think I should be a landlord and rent out my flat.” If you are thinking that you would like to be a landlord, there are a few ground rules to understand before you start your journey. Since there are many official rules and regulations with respect to the landlords and their tenants, it is also worth mentioning that landlords have the most power in this relationship as well as the heavier burden of duties in fulfilling the rights of their tenants. The major points of being a landlord should be contained in the rental agreement. No tenant should take occupation of a property if they haven’t signed off on a legally drafted tenancy agreement. The agreement sets out the obligations of both parties, most of which are covered under the Landlord Tenant Act. Since the tenant is the occupier of the property, the landlord will have to present him with a fully functional and suitable rental space, functional in the sense that everything that is contained within, should be in working order and everything that it has in terms of either being furbished or not, should thereby be suitable. Another important responsibility of the landlord is that they should always perform health checks and suitable upkeep should be done of the rental space, so that they can be sure from their side that nothing will endanger the lives of or harm their potential tenants. The landlord must make sure they contact all the societal councils to see what has to be done to the rental space to make it habitable and suitable according to the criteria of these councils. Another major responsibility of the landlord is that he/she should always make clear the house rules and codes for when a tenant moves in. This is important because when the tenant moves in unaware of their own obligations, there is a greater likelihood to make mistakes and violate the rules. It is also within the realm of responsibilities of the landlord that he/she makes regular checks so that he/she will be aware of the fact if any violation of the house rules is taking place and tackle it sooner rather than later. Last, but certainly not the least, the landlord must make sure he also respects and fulfills the rights of the potential tenant. If the landlord makes himself out to be the dominant entity without a feeling of compassion and care for his tenant, then the tenant will feel violated of rights. To maintain this relationship, there has to be a certain level of give and take, in which both parties give and take equally.
