The Sentencing Reform Act of 1984 establishing the Federal Sentencing Commission and the resulting Federal Sentencing Guidelines needs to be repealed. The current Guidelines, while not mandatory since the Booker decision, are used to bludgeon defendants into plea agreements regardless of the merits of the case thereby making a mockery of due process, and are used to rationalize sentencing defendants for periods of time exponentially higher than similarly situated state offenders. There is no justice for many under the current system.
