The Watertown Police Department has received numerous complaints of ATVs being operated in the ditches and right of ways within the city limits. We would like to remind people that it is a City Ordinance violation to operate an ATV in the roadside ditches or right of ways within the city limits. This includes all highways within the city. The fine for a violation of the ordinance is $114.00. 19.1403: UNLAWFUL AREAS FOR OPERATION It shall be unlawful to operate any off-road vehicle on any area within the corporate limits of the City of Watertown except on a highway as that term is defined in this chapter. This prohibition shall not be deemed to apply to operators of off-road vehicles on any lake, river or stream under the control or jurisdiction of the state or federal government, nor shall it be deemed to apply to operators of off-road vehicles on the private property of another with specific permission of the owner or person in control of said property, and with such permission in writing and in the possession of the person operating the off-road vehicle. It is an express provision of this section that it shall not be deemed to apply to any duly authorized law enforcement officer operating an off-road vehicle while engaged in any authorized law enforcement function, nor shall it be deemed to apply to any other authorized governmental agency engaged in a legitimate public purpose function. Highway is defined as: the entire width between the boundary lines of every way publicly maintained when any part thereof is open to the use of the public as a matter of right for purposes of vehicular travel.
