The cases are filed, the volumes are bound and the bags are packed. Our mental capacity specialist, Philippa Curran, is on her way to the three day hearing at the Supreme Court in London to hear the arguments put before seven judges in the eagerly anticipated cases of P v Cheshire West and Chester Council and P&Q v Surrey County Council. It is over four years since we first received instructions from the Official Solicitor to act on behalf of P, a gentleman with severe physical and learning disabilities. As he is unable to make such decisions for himself, the matter was brought before the Court of Protection, in order to determine whether his placement in a shared house and his package of care, provided by the local authority, CWCC, were in his best interests. Since then, this case has gained significance as it provides the Supreme Court with the opportunity to make a landmark decision when it addresses the issue of what is a deprivation of liberty. This decision is expected to impact upon incapacitated individuals and their families across the country, as well as the local authorities, hospitals and care homes, who care for them.
