The dilemma of invoking article 245: The government’s decision to invoke article 245, requesting the army to work in aid of civilian authorities from 1st August 2014, for three months – has received a lot of flak from almost all political parties and current affairs analysts. Now doubt the calling of the Army, under article 245; which gives them legal immunity, even from the jurisdiction of the High courts, while performing their duties, can neither be termed desirable, nor propitious for democracy. The move, however, is permitted by the constitution. In spite of myriad explanations, it is not difficult to see, that it is PTI’s threatened March on the capital on August 14 that has compelled the government, to take the extra ordinary step of invoking article 245. The government is, perhaps, rightly blamed for resorting to involve the armed forces in a political matter; but Imran Khan’s immature and belligerent statements, also have a role in forcing the government to take this extreme step. Imran’s plan of bringing a procession of one million to the capital, and then staying there till their demands are not met; can not be called anything less then a political black mail. Surely even a million people do not have the democratic right to over turn the mandate of over 18 crore people. What ever is the size of Imran’s procession, it cannot be allowed, to hold the citizens of Islamabad hostage indefinitely? The bellicose tone of PTI, leadership betrays their violent designs – once they are in the capital. It is the primary duty of the sitting government, to protect the life and property of its citizens by acting legally and with in the ambit of the constitution
