The government has opted for the ordinance route to effect the ambitious food security project. As article 123 of the Constitution clearly spells out that if the parliament is not in session the government can legislate through promulgating an ordinance on an issue that demands immediate attention. But what needs to be considered here is not just the letter but the spirit of this particular article. It assumes the government having a majority in both houses of parliament and therefore implies the approval of majority of the parliament. Even the BJP in 2001 brought the draconian prevention of terrorism law through the ordinance route when most of the opposition parties were against such a move.
