“The prosecution had a habit – it may be a policy – to take a witness’s account, see if it ticked boxes of the elements of the charges. They have something called an ‘in-depth analysis chart’. They ticked it off and, at the end, if all the boxes were ticked, they put forward a case. But that’s not how you should do it. If I say: “I was in the cafeteria of the ICC three weeks ago,” you can’t take my word for it. You would go and check the record.” That’s Deputy President William Ruto’s lead counsel at the #ICC Karim Khan giving his cents on the prosecution’s record in sources witnesses. Do you agree with Khan that the prosecution didn’t do enough to verify the testimony of its witnesses?
