The state board for a medical profession is a regulatory agency, and does not have statutory authority. The legislature determines statute. A medical profession’s scope of practice is determined by statute (i.e. law, not regulations, which are rules/practices established to enact a law). By my interpretation, the Board of Physical Therapy in AZ has just exceeded its authority by expanding scope of practice for PTs to include dry needling without an appropriate statutory mandate from the legislature.
