This is outrageous. 1. The students actions were entirely innocent--there is nothing inherently evil or dangerous about posing for a picture with toy guns. 2. The action took place on private, non-school property. Accordingly, the school has no jurisdiction over the conduct. 3. The purported reason for the suspension was the disruption that ensued. In other words, these children are being suspended because of something that OTHER CHILDREN did. It is difficult to conceive of a more egregious violation of these students due process rights--their constitutional right to attend school is being abridged because of something that other children did in response to their innocent behaviors on private property that did not violate any pre-existing written rule or policy. Heres what needs to happen: 1. Students suspension needs to be rescinded immediately; 2. The administrators who suspended the students need to be suspended pending a disciplinary hearing directed toward the dismissal of that person or persons; 3. If the foregoing does not take place NOW, the parents need to get a good lawyer and sue everyone in sight. Ask for punitive and exemplary damages.
