This is proof from the board that they did not follow the bylaws before, and they still are not following them now. We had a lawsuit challenging this rule about 15 years ago. The unit owner refused to pay a fine and the board did not allow him to run for the Board. He took us to court , the judge agreed to hear his case and forbade us to hold elections until he heard the case and can come up with a decision, It took about a year before the case was heard. The Judge ruled for the plaintiff because the fine was excessive. Our rules state that no fine can exceed $50 and the plaintiffs fine was $100. The Judge did not rule that our rule was illegal he ruled that the fine was excessive. So he ruled for the plaintiff. The rule is still legitimate. They and their bogus election is not.
