This is the person that I had an interview with a year and a half ago. The there companies that she was listed with were all clerk and phone sales jobs. One was a clerk at a Pizza restaurant. The company I interviewed with (her) was totally OK with my background and I had about an hour interview. Then she would not return any of my calls. When I finely did talk to me she told me that I am, Permanently unemployable. This company was connected to GM as was the company that did my background check. She would not tell me that I was on a blacklist. She also did not mention that the person that was on the blacklist was bought out to shut him up for whistle blowing. She also never mentioned that blacklisting in Michigan is a criminal act. We have conspiracy laws in Michigan that means that anyone that conspires to conceal a criminal act has committed a felony. They can get a sentence higher than the act that they concealed even if the person that did the act is not convicted. I spent the day reading about blacklisting. The person that blacklisted me is an executive in the company. She admitted to being the person that put me on this list. She admitted to buying the silence of the real person that she blacklisted. She is the companies HR policy director and apparently this is their policy. The actually hiring people have a different view and are trying to correct this. I would love to see the expression on her face when she would had if she would have met with me. My ancestors are from England, Scotland, Ireland and Sweden. The David Day that they were dealing with is an African American and a minister type. He is listed as being in finance and I was in electrical engineering. There are so many differences that it is virtually impossible to make this mistake. It looks like when he was blacklisted his data was randomly inserted to other David Days. The HR person form the GM Headquarters claims to have met with me and the GM lawyers. She would not meet with me. I asked for proof that this happened and she read me some of the things that I agreed to for the buyout. I wanted a copy of this and was refused. She listed no money but told me that I wanted back because I had run out of money. She told me that if I was ever found on GM property that I would be arrested and prosecuted to the fullest extent of the law for trespass. This should have tipped me off to something. When I was laid off I was told that I and the other 47,000 were being let go because of economic issues. If someone has an issue with someone then they should deal with that person not some random victim. I was an extremely good employee. This has fouled my record. This kind of information has already reached the extents of the industry. I have no idea how they are going to cleanse this problem. Would they write to every company that I applied to or any company that I will apply to in the future and say: HR Director of company X: We are writing this letter to correct an issue that we created. We had a former employer of our company was a whistle blower. We bought his silence and other things. We accidentally put his records in the files of another or others which describes everything that happened. In doing so we have told every background checking organization about this. We also provided background information to everyone of the 1200 (+) companies that he applied to preventing him from being a qualified candidate for any company in his field. This letter is to verify that we made this mistake. The mistake was an HR issue that was done without his knowledge. Responsible person; I know this would not happen, because no one would make this accident. It put stress on my family. I spent and still spend an enormous amount of energy in continuous learning. It is totally unfair that the people that I have talked to knew what has happens and failed to help. These people are in positions of responsibility. They are the hanging fruit that will have to provide the answers. Their system has safeguards to prevent this from happening. So this was not an accident, but a deliberate act. My files cannot accidentally be damaged. There are codes and passwords and people that are by the law in Michigan the, Curator of record. Nothing is accidental in an employees record. Any changes must have approval and other know. Think of an employees record as a read-only file. It can nor be accidentally damages or edited. For change to be made there has to be many people involved to unlock the file and make the change. These people will also know what the change is and what the result is. We are not talking about a filling station where the record is a piece of paper in a drawer. My paper record are at Iron Mountain a permanent storage place.
