There has been a long history of governments using emergencies to strip away the rights of the people for the people’s “own good”. Even though our government never call their crackdowns “martial law”, we have seen textbook martial law events happen in Ferguson Missouri, in New Orleans during Hurricane Katrina and in Boston during the Boston Bombing manhunt. This technique has been used all throughout history because the people have almost always allowed it to happen. One thing that tyrants can always count on is being able to play on the people’s fear as a way to gain more power and more control. For the most part, the masses hail strong leaders that protect them, even if that protection comes with violence and suffering. Fortunately for us, our Founding Fathers understood that emergencies are no excuse for the stripping of our rights, which is the reason why they did not add any caveat language in any of the founding documents in regards to states of emergencies. Nowhere in the Constitution or in the Bill of Rights does it say that our rights are protected except during cases of unrest or catastrophic events. I personally think that states of emergency requires even more protection of liberty. The rights of the people must never be infringed no matter the situation, because if history has taught us anything, it has taught us that it is too easy for governments to maintain restrictions on personal liberty after the emergency is over. The main problem with martial law is that it allows indiscriminate use of force and the denial of liberty with no oversight. There have literally been dozens of videos coming out of Ferguson were innocent people who are just standing around are getting caught up in violent actions by the police. Even people who are sitting in their homes were the subject of gas attacks and no warrant searches. This highlights the reality that all cases of martial law come with denial of basic liberties. This is evident by the targeting of journalists, the curfew that was instituted, the “free speech” areas, the house to house searches, and the random arrests of people who are doing nothing other than protesting what they see as an injustice. In a sense, Ferguson was a city where the Bill of Rights was no longer the law of the land. Aside from the unconstitutional nature of martial law, the very act of cracking down on an entire group of people breeds even more violence among those who are trying to enforce “the peace.” If you look at what happened during the Ferguson protests, you will see that a gang mentality took over in the police. They all started seeing protesters as the enemy and justified their use of excessive force for the simple reason that all of their buddies were doing the same thing. There have been many psychological studies that show when someone is told that they are justified in doing something that they know is wrong and the people around them are also committing that act that they will almost always follow the crowd. It is the same reason why Nazis where able to get seemingly normal people to commit horrendous crimes. When people in authority tell a person that an evil act is good and if the people around them are doing the same thing, 99 times out of a hundred the person will follow along. That is why martial law is possible and that is why police forces throughout history have followed blindly when given orders to oppress and hurt their neighbors and fellow citizens. The fundamental problem with martial law is that it assumes that the government is the one that grants our rights and that they have the ability to remove those rights when it becomes convenient. All of our unalienable right, from freedom of speech to the freedom to bear arms, are granted by God and are protected (or should be) by the government. The frequent use of martial law within the borders of the United States is symptomatic of where our nation is going. Only now are the people starting to scream and cry about the militarization of the police, even though most of us in the liberty movement have been talking about it for more than a decade, but these screams might be a day late and a dollar short. We have allowed our government to pick and choose which rights to protect and have permitted (and often times praised) the government to place our “safety” above our liberty. I highly doubt our leaders are going to be willing to give up the control that we have so willingly given them.
