Video played in a Travis County courtroom Wednesday shows an Austin Police officer firing 15 rounds into a vehicle, striking the driver five times including one shot in the head. The driver, Miguel Macias, is on trial for aggravated assault on a police officer with a deadly weapon because prosecutors say he was trying to injure Officer Shane Cunningham, prompting the officer to open fire. The jury deliberated Wednesday until 9 p.m. and broke for the evening, and will resume deliberations at 9 a.m. Thursday. Officer Cunningham was responding to a burglary on August 31, 2013. The defense attorney says Macias was just trying to get away and was not using his car intentionally as a weapon. The jury returned a ‘no bill’ verdict against the officer, indicating he was justified using such force.
