To Date: 18-07-2013 The President APGBOA/APGBEU Subject: Pension eligibility in RRB case With reference to the Govt. of India affidavit filed in the Honourable Supreme Court during the hearing of Regional Rural Banks (RRBs) pension case on 09-07-2013, it has been submitted by the Govt. that employees who are in the system up to 01.04.2012 would be eligible for pension. This point needs reconsideration for the following reasons:- 1. A decision or scheme if it is introduced first time in any organisation needs to be first implemented on all present working employees and then amended later on. It should not be the case where amendment schedule (cut-off date) is decided beforehand with division of employees. 2. The pension scheme implementation if allowed and permitted by H’onble Court will be the first implementation wherein the rules for such process will be framed for the first time and it should happen in similar pattern across employees. 3. Employees in the RRBs system who joined before 01.04.2012 or after this date belong to and have affiliation with one and the same institution, pension case and have similar job requirements. 4. Any decision requires uniform implementation norm wherein it should not be the criteria to include certain percentage of employees and exclude the remaining employees working under the same roof and for the same organisation. 5. There seems no logic for cut-off date. It seems to be randomly selected. It is not in the overall interest of RRBs employees if such a thought regarding cut-off date is brought into picture to divide the employees. Without logic, cut-off date could be any that would go against the employee sentiments and the principles on which the pension case was filed. 6. In the past the implementation of any such decision has been uniform in the respective organisation/institutions across cadres and grades. 7. We request all employees and concerned unions to unitedly pursue the case for uniform implementation that should benefit all employees equally. 8. We also request all new as well as old employees of RRBs to raise the issue with their respective bank’s unions and the central unions (AIRRBEA, AIRRBOF) Regards: Signatories of PGB
