Today marks the 10th anniversary of Mississippis landmark tort reform legislation being signed into law. Prior to passage of tort reform, Mississippis legal climate was the worst in America. Businesses and doctors were fleeing the state due to skyrocketing liability insurance costs. Mississippi had become a joke on the national stage for its reputation for jackpot justice. Trial Lawyers like Chris McDaniel were getting rich at the expense of the states economy. Governor Haley Barbour and conservatives in the state legislature fought the trial lawyers and won, successfully enacting comprehensive tort reform that has been called a model for the rest of the country. Companies like Toyota, Yokohama, and many more would never have invested here without this crucial piece of legislation. Where was Chris McDaniel? He claims to be a supporter of tort reform, but his record tells a different story. Chris McDaniel sued, arguing that the caps put in place on punitive damages were unconstitutional. Result: Chris McDaniel reaped a $25 million payday. What kind of conservative argues that tort reform is unconstitutional? The kind of conservative that is more concerned with getting rich suing people than standing up for Mississippis doctors and small businesses. Whether its tort reform, common core, deficit spending, or raising taxes, Chris McDaniels record is very different than his rhetoric.
