URGENT IMMEDIATE CALL TO ACTION!!! This morning the House of Representatives begins debate on HR 5078, the Waters of the United States Regulatory Overreach Protection Act of 2014, sponsored by Rep. Southerland (R-Fla.), with a vote on it either later today or pushed to later this week. HR 5078 would do three important things: (1) invalidate the “Waters of the U.S.” proposed rule by EPA and the Corps of Engineers; (2) invalidate the Interpretive Rule that deals with 56 NRCS conservation practices; and (3) require the agencies to consult with the states on any such rulemaking in the future. Attached is a support letter that NCBA sent to the House. The legislation has 120 cosponsors that you can review here. CALL YOUR REPRESENTATIVES AND ENCOURAGE THEM TO VOTE YES ON HR 5078, the Waters of the United States Regulatory Overreach Protection Act of 2014. Also, NCBA has completed the mapping project commissioned on stream miles and floodplains that show the extent of the proposed rule. Any member of the public can access the maps on our website at beefusa.org. The 17 states in red are those that we had mapped, but the other states have data included in them as well that was done by USGS and we have had the contractor include so everyone should look at their state. Recently, wetlands have been added to the maps. You can zoom in as far as it will let you, change the type of map you are looking at and take screen shots of specific examples. The Legend on the side will let you know what type of feature you are looking at. For those 17 states that NCBA had mapped, the attached table tells you the increase in stream miles that is under the proposed rule. It also gives you the FEMA floodplain acres in your state (“all open waters” in a floodplain or riparian area are jurisdictional under the proposed rule). Please distribute the link at will (we encourage state affiliates to place it on their websites), use the maps as you speak with your Congressmen and Senators, and utilize the maps for your specific state comments.
