US presidential candidate Andrew D. Basiago has acted to protect the American people from legal fraud by denouncing Judge David Wynn-Miller as a fraud. Basiago, who practices law in Washington State, consulted Wynn-Miller about a case in Washington in which a young man is serving a term of 10 years to life for a statutory rape that he did not commit. Basiago found Wynn-Miller to be perpetrating fraud in seven areas of legal practice. First, licensing as a lawyer. Basiago found that Wynn-Miller has never studied law at an ABA-approved law school and is not admitted to practice law in any US jurisdiction. Second, status as a federal judge. Wynn-Miller told Basiago that he is a federal judge. Basiago found that no official list of US federal judges includes Wynn-Millers name. Third, professional honors. Wynn-Miller told Basiago that he was awarded the Distinction of the Solomon Islands for helping that country secure a legal victory using his Par Se Grammar-Syntax method of legal analysis. However, when Basiago contacted the embassy of the Solomon Islands in New York City, two weeks later the second-ranking diplomat of the Solomon Islands in the United States informed Basiago that it has never awarded an accolade of any kind to David Wynn-Miller and its records show that the government of the Solomon Islands has never had any contact with a person by that name. Fourth, diligence. During the period when they were in communication, Wynn-Miller told Basiago that he had completed a 70-page brief on the documents from the case of Basiagos client. During a later telephone call, Wynn-Miller stated that he had written no such brief and revealed that he did not remember the brief or ever stating that he would write such a brief. Fifth, honesty. When Wynn-Miller informed Basiago that he had completed the brief, he lied to the attorney of a young man languishing in prison for a felony that he did not commit. Sixth, zealous advocacy. Basiago found that Wynn-Millers fraudulent assertion that his Par Se Grammar Syntax methodology can prevail in American legal cases has been to the detriment of many of his clients. Seventh and lastly, legal theory. There is no support for Wynn-Millers assertion that his method of Par Se Grammar-Syntax is a valid form of legal analysis or legal argument before American courts. The reason is that in American jurisprudence, the actual meaning of a statement governs the form that it takes as to such factors as word choice, grammar, or syntax. For example, under the Hillmon doctrine in the law of evidence, a partys statement of their intent to do something can come into evidence to show that they did something. Such a statement cannot be refuted on the basis that it was a statement of intent rather than action. Wynn-Millers claim that he can achieve such legal goals as invalidating a contract or winning a criminal acquittal via grammar and syntax analysis of the words used is patently false. Basiago believes that Wynn-Miller should be charged with the crime of impersonating a federal judge and has vowed if elected President to prosecute him. Judge David Wynn-Miller is a menace to society, the candidate stated. I am mystified as to why this man has been allowed to perpetrate a fraud on the American people.
