Unfortunately, a tactic of many politicians is to wait until the final days of a campaign and then fill our mailboxes with negative ads at a time when it is too late for the other candidate to respond. This, along with radio (KWRE & KFAV) and newspaper ads (LCJ) is my effort to respond to Mr. Pietzman and the Republican Party. They may mail more negative ads that I will have no chance to respond to. It is very expensive to conduct such a campaign. You can go to the Missouri Ethics Commission’s website to see that Mr. Pietzman’s campaign has spent nearly $100,000 thus far. You will see that these ads are part of Mr. Pietzman’s campaign. They are listed as “in-kind” contributions. It is my understanding that Mr. Pietzman posted on Facebook, “I would like to clarify and let everyone know that I was not responsible for the mail-outs about my opponent. In fact I spoke against the idea.” If he has no control over his campaign; who is controlling his campaign? Several weeks ago, some of you were asked to participate in a phone survey. It involved a series of questions to determine what could be said about me that would result in votes for Mr. Pietzman. That was research for the negative mailers. The first two negative mailers that came of this survey referred to my expanding “Obamacare”. 1. Response to mailer about “OBAMACARE”: State representatives make laws for Missouri. State representatives have no authority to change federal laws such as the Affordable Care Act. Federal laws are made by U.S. Representatives. I do support expanding Medicaid, a Missouri law, as do the state’s leading business groups, health care experts, hospitals and many members of each party. Retired U.S. Senator Kit Bond, a republican lobbied tirelessly for Medicaid expansion. A University of Missouri study found that Medicaid expansion would: * return to Missouri over $1 billion per year of our federal tax dollars; *would provide insurance coverage to roughly 300,000 working people who CAN NOT afford insurance, many of whom are veterans; *would prevent an estimated 700 needless deaths in Missouri each year; *would generate more in state and local taxes than Missouri’s share of the cost; and *would create more than 24,000 good paying jobs in Missouri Today I received a mailer that sated boldly on it that I had “ignored a unanimous decision by a jury” to and released a heroin addict. 2. Response to mailer about Setting a heroin addict free: I did set aside a jury’s verdict in State vs. White. To uphold the law is not always the popular thing to do, but it is the right thing to do. During the trial, it was established that Mr. White was a heroin addict. However, it was not established that he possessed the heroin that was found; nor that it did not belong to one of two other people living with Mr. White. The State appealed my ruling, and a unanimous decision of the Court of Appeals said I did the right thing. That decision by the Court of Appeals is public record. During my 12 years as circuit court judge, I entered over 20,000 orders and judgments. On 99 occasions, one or more of the parties involved sought review by the appellate courts, and the appellate courts found error in only 12 cases. I was asked to serve as a special judge on the Missouri Supreme Court in 2008. In 2010, I was asked to preside over a class action lawsuit from St. Louis County involving more than $80,000,000.00. In the event that Mr. Pietzman has further negative mailers, please keep in mind that I could respond if time permitted. Also, what does it say about a candidate’s character to use these tactics and then say he is not responsible?
