Then the doctors lawyer will counter with a statement that if you lose you will be held responsible for all attorney fees and court costs. That usually deters many from following suit. Much easier to bring suit in small claims court. This way you wont be liable for any attorney fees and they cant strongarm you into submission. In the end, the doctor who thought they could get away with intimidating you will have a record and think twice (likely more) next time before intimidating any other patients. If approached in mediation with a settlement amount, remember, if you accept there will be no record regarding the doctors misconduct for future patients to peruse. Theyll think again if they know a pattern can be established based on their record. A blemish on the doctors record is worth a thousand words and a million dollars. In Ralph Naders case he took the money. Dont take the money, take the verdict... Youve got 5 to 7 years to file suit.
