Update Court Action by Mohamed El-Mouelhy We can now confirm that Mohamed El-Mouelhy as the sole director of ‘Halal Certification Authority Pty Ltd’ has lodged a ‘Statement of Claim’ against Q Society of Australia Inc, YouTube LLC as well as four individuals. He claims defamation and seeks “damages”, “aggravated damages”, “interest”, an “injunction against further publication of the matters complained” and “costs, including costs on an indemnity basis”. His claims are based on two videos published on our YouTube channel. We would like to clarify: 1. Mohamed El-Mouehly operates his business selling Islamic halal certificates in Australia. These certificates confirm that in the opinion of ‘Halal Certification Authority Pty Ltd’, the supplier or service provider uses methods, materials and ingredients conforming to the relevant sections of Islamic sharia law. Mohamed El-Mouehly achieved some notoriety after he was interviewed by a current affairs TV program in 2012. In this interview he boasts to have become a millionaire by selling halal certificates. Here is a recording of the program: https://youtube/watch?v=zZbC0zPoX2I There are approx. 20 Islamic organisations and companies selling halal certificates in Australia. There is competition between these organisations and the authorities of certain Islamic country will not recognise the certificates of all issuers. For example according to a list published by the Australian Department of Agriculture in November 2014, the certificates issued by El-Mouehly’s company are not accepted in Indonesia, Malaysia, Saudi Arabia, Singapore, Qatar and the United Arab Emirates for red meat. Reportedly Indonesia’s MUI disqualified Mohamed El-Mouehly in 2006 for not involving food scientists or Islamic law experts in his company: islaminindonesia/tag/mohamed-el-mouelhy/ 2. The board of Q Society shares the view of our law firm that Mohamed El-Mouelhy has no claims based on the content of these videos: https://youtube/watch?v=YVPngzSE94o https://youtube/watch?v=mSP47FAtn6U The first video explains the basic concept of halal food in Islam and provides information about the recently invented halal certification schemes and examples how these schemes are applied. The presenter is Q Society member Kirralie Smith, who undertook significant research into this matter. She operates the website halalchoices.au and publishes the HalalChoices shopping guide. The second video is from a presentation Kirralie gave at our 1st Symposium on Liberty and Islam in Melbourne in early 2014. 3. The next step is a so-called ‘directions hearing’ at the NSW Supreme Court to decide how these claims should be dealt with. Q Society has instructed our law firm to reject all claims by Mohammed El-Mouehly. Given the current political discussion about Islam in Australia and world-wide, this case – should it indeed proceed to the next stage – will undoubtedly raise considerable interest in the media and the general public in Australia and abroad. The extra publicity would provide us with additional opportunities to bring the truth about halal certification schemes before an even larger audience. Individual members and reg’d supporters of Q Society of Australia Inc have nothing to be concerned about, there is no legal liability for you. Q Society is incorporated as a not-for-profit association in Victoria and ordinary members or supporters do not incur any liability for the legal entity under Victorian law. 4. If you want to support us in this matter, here is what we ask you to consider:Support Kirralie and her work by making a donation at the HalalChoices.au website and by buying the HalalChoices shopping guide at the HalalChoices website. Kind Regards Raoul Machal Q Society of Australia Inc qsociety.org.au PS - Please note that Q Society never called for boycotts against Australian halal-certified businesses. We have always advocated for giving consumers a fair chance to make a concious decission and for other ways to ensure religious observant Australians can eat according to their beliefs; while at the same time putting an end to the halal protection rackets and their wholesale imposition on all consumers.
