VERBATIM REPORT OF THE KIRINYAGA COUNTY ASSEMBLY PROCEEDINGS HELD ON WEDNESDAY 2ND OCTOBER 2013 AT KIRINYAGA CHAMBERS Hon. Speaker. (The session was chaired by Speaker Hon. Ann Wangechi Githinji) (Clerk Samuel Kago) The session started at 10.59 am with a prayer by the Hon. Speaker. Communication from the chair. Hon. Speaker. Honourable members we have the County Integrated Development Plan for the Kirinyaga County which is a legal requirement that we deliberate. Honourable Mathenge is leading the process of the CIDP and after this we can either formalize its adoption or rejection in the afternoon that is 2.30 pm. Honourable members, the chair appeals upon all the members to remain after this session so that he can take you through the bulky document. But a lot of it is borrowed from the budgets of various ministries and departments, so kindly remain after this session. Honourable members we have also received a letter from the County Executive Committee member of Trade on the establishment of a SACCO for the County Assembly staff members. I have officially handed over the same to honourable Joel Wagura so that he can guide us on that process. He will give this house a whole report on how to go about it. The document is laid before his committee to give us a way forward. This was a good gesture from Stanley Kathaka Gachuho and is dated 15th October 2013. That’s all on the communication from the chair. Motion. Hon. Joel Wagura. I rise to move a notice of motion. My first notice of motion is on apportionment of primary school compounds to accommodate ECDE. Madam Speaker, AWARE that the national government devolved ECDE to the County Government and also aware that in most primary schools ECDE classes share the same classes and compound with the primary schools it will be difficult for the County Government to serve the ECDE with the special attention that it deserves especially considering the fact that primary schools are not devolved. Also considering the age of the ECDE children and in order to impact positively to the County Government, funding in its bid developed such compound as to accommodate new model ECDE and model toilets. Bring this notice of motion that this house moves that all primary schools be required to spare space for ECDE. Madam Speaker, I also wish to give a second notice of motion on creation of independent management committee to serve individual ECDE. Motion. Hon. Joel Wagura. AWARE that most ECDE are served by the same management committee that serves the primary schools that hosts them and that most ECDE centers are neglected and thus less attention given to them thereby hindering any visible development, And also considering that most ECDE have neglected infrastructures and taking note that for the first time they are going to receive County Government funding. Madam speaker, I bring this notice of motion that this house moves there be formed separate management committee to run the affairs of the individual ECDE. Madam Speaker i would also wish to bring a third notice of motion on a different matter based on tracking creation of County Youth Empowerment Fund. Hon. Speaker. Honourable member that is your second notice of motion number two? Hon. Joel Wagura. Notice of motion number three Hon. Speaker. Take us through the numbers because they are various and many. Hon. Joel Wagura. Thank you; it is notice of motion number three. To fast track creation of County Youth Empowerment Fund. Madam speaker, Motion. Hon. Joel Wagura. COGNIZANT that the youth form an integral part of our county population and though fairly educated most of them lack the capacity to propel themselves to other levels of development thereby making them more vulnerable to drug abuse and other immoral practices and also aware that the youth sector has not been fully devolved. I bring a notice of motion; THAT this house moves that the Youth Empowerment Fund be created so that it can easily be accessed by the youths in the County to assist them start small micro-finance enterprise programs and hence give them a chance to enjoy the national cake and as an end product, make productive members of the society. Madam speaker, I also come to my forth notice of motion on regulation and harmonization of Boda Boda business. Madam speaker, Motion. Hon. Joel Wagura. AWARE that the Boda Boda business has become a modern form of investment from which some of our youths derive their survival, and taking note that some cartels have been in the recent past demonized this venture causing all manner of mistreatment to customers and also including rampant accidents as most riders ignore traffic rules at will, madam speaker I bring this notice of motion; THAT this house moves to regulate and harmonize this business in order to bring sanity and modesty in the way it is conducted. Madam Speaker i also bring the Fifth notice of motion on the introduction of measures to abate smoke and carbon dioxide emissions. Motion. Hon. Joel Wagura. AWARE of the fact that we all need clean air and that most households use open fire to prepare meals and to warm their houses, and also aware that this practice has continued unabated ignoring the fact that carbon emitted impacts negative on our health. Madam speaker I bring a notice of motion; THAT the County Government endeavours to educate the masses against the use of open fires and more so providing sub sized energy saving stoves that have less carbon emissions. I also recommend that since this can be assembled locally, we use the locally available materials. Thank you madam speaker Hon. Speaker. Those are five notices of motions and I hope members you are well informed. It is good to enlighten the members with the ideas that he has so that we can see if some can become regulations of the county laws and create order in our county. Now we proceed to statements, motions and bills. Hon. Jackson Murimi. Madam Speaker under Standing Order 49 in this house, I want to table some documents which should be adopted by this house. The reason for having this quick motion without notice is for this county to move we must reduce many land disputes and start transferring of the plots. Madam speaker, many of our residents are suffering without any appropriate mechanism of addressing their issues. The committee for Physical Planning and Housing agreed all disputes and transfer requests will be registered at the County Transition Authority Coordinator office head quarters at Kutus. Madam Speaker after registering, they forward the document to the technical team for documentation. The MCA’s would be notified on the issues of their respective wards in order to reach them within two weeks. Madam Speaker, disputes would be heard on second Monday of the month. Transfers would be considered on every second Friday of the month. I request the honourable members to adopt these documents before we pass the Finance Bill since the fees were captured. Madam Speaker these are the documents; transfer or withdraw of ownership, plot, kiosks, village, market, store or lockup. Another form is for application for addition of partners, another one for application for sub division of plots, another one for application for dispute resolution and fifth one for surveying of plots. Madam speaker I would wish honourable Mungai to support my motion because he is the vice chairman of the docket. Hon. Joseph Mungai. I rise to support the motion of this document. Since the County Government was put in place there have been so many disputes and many court cases regarding plots in our County due to lack of proper mechanism of how to transfer plots. There are those people who would like to sell their plots may be for some reasons like they want to settle hospital bills or for parallel degrees and maybe after going to advocates and writing an agreement, there is time limit to effect the transfer. And since we have not started this exercise, some of these transactions have ended in courts of law. There are also those who would like to have an additional partner to their plot, for example a father would like to add a relative or son and yet you have not started to do so. There are also who own plots on equal portions and would like to subdivided. It has not been effected. There are also disputes, madam speaker, which may also result to death and I would urge members to support this because we want our Kirinyaga County to continue with land transactions. Again in matter of disputes it is advisable this exercise be involving ward representatives whenever there is a dispute or they will be notified whenever there is a case in their wards even if it is surveying of the beacons. I therefore urge members to adopt this document so that we can take our county to move and again madam speaker, this is also a source of revenue and it will add value to our county. Thank you. Hon. Speaker. As members, you have heard the urgency of the motion which is approved by the Speaker, they want you to adopt. We are coming from councils to County government and it is now becoming challenging for them to work with the old papers. Members are been asked to adopt this application modified formats so that various departments can be able to deliver services and generate the revenue. That is the motion before the house. Hon. Jamleck Kariuki. I rise to support the motion but I would like to request the mover of the motion to may be supply us with these forms so that we can see the format. Thank you Madam Speaker. Hon. Joseph Mungai. Madam Speaker, I think these forms are available may be the member of Njukiini has not received one, I would urge the chairman to give him one. Hon. Speaker. Honourable Mathenge. Hon. David Mathenge. I rise to support the motion that we adopt these forms. I have gone through them and they are well set and also members, I would wish the chair Physical Planning Committee to communicate to the public because each and every time, they are asking us various questions. When are these exercises going to commence. It is also good that you communicate to our members in the public and tell them when you are going to commence these exercises because various members may be are in need of money and there is no way they are going to sell their plots or some of their stalls through the old application forms. So a member is an urgent that needs an approval may be today so that this exercise would commence immediately. Thank you Madam Speaker. Hon. Speaker. Yes honourable Mary. Hon. Mary Muchiri. I rise to support the motion because it is important to have an order in dispute resolution especially when it comes to the owner ship of the lands. Thank you Madam Speaker. Hon. Mwai Wachira. I stand to support this motion because it is very important. As members you are aware, I come from the ward with so many land disputes. Like for example as I am standing here there are issues of land whereby schools have been grabbed by those former councilors and some of these lands have been sold. Madam Speaker, There is an issue whereby a primary school had ten acres and as am speaking, right now we have two acres of the same school. So I find that this motion is very important because of that kind of issues. Another issue is that, most of the people are getting old and they want to transfer their lands or plots to their sons. Then there is this issue of surveying of the plots. These cases are also very many. I therefore support this motion so that these disputes should be dealt with to the end. Another thing is that, our County has been losing revenue because this exercise was stopped since we took over the office. I support the motion. Thank you Madam Speaker. Hon. Speaker. Yes honourable Kagori. Hon. George Kagori. I rise to support the motion. Fully aware that in Kirinyaga we have a lot of land cases and knowing that land is very emotive issue, we need to have order and resolve these issues that are emanating from land cases. Going by statistics, more than seventy percent of cases in Kirinyaga are land related according to the police statistics. Therefore, it is important to pass this document to ensure that these land matters are resolved once and for all so that our County can have peace. Our people are living in disharmony emanating from land disputes and plots. I support. Thank you Madam Speaker Hon. Speaker. That is all we have from the members so that we move to the mover of the motion. Hon. Jackson Murimi. I want to thank my colleagues for showing their concern to the people of Kirinyaga County. Madam Speaker I have also heard that it requires immediate action from honourable Mathenge. I support what the chairman is saying, and say that in every land transaction which will be done, every member from respective wards where there will be disputes, sub-division, every MCA should be involved. Let’s address the issues of the committee at 2.30 pm in the mean time I want to restrict myself to the motion before the house. I want to put a question strictly on the motion before us.
