Via~Aaron MoonDogg Edison WELL,,again they are coming after me. Back in 2001 I went through a forced divorce that neither my wife or I wanted. I was accused of abuse because I had given my then 12 year old son a spanking for getting suspended from school and then lying to me about why he was not in attendance. The spanking left no marks or bruises and even with all the trumped up charges and accusations the judge admittedly could NOT substantiate any abuse. Yet I was ordered to attend the states MDT/ Family counseling or loose my parental rights. Because of my background with degrees in Social Work and Sociology and being a practiced counselor for 14 years I refused the states counseling and requested CHRISTIAN FAITH BASED COUNSELING for my family. This request was denied by the Judge and my parental rights terminated (not because of substantiated abuse which is required in order to terminate a persons parental rights) because I refused to attend the STATES counseling program. My then wife was then coerced into filing for a divorce because I could no longer be around my children. Once the divorce was finalized a year later I was then ordered to pay child support for children that I had no parental rights to. I refused to pay based on the grounds that if I have no rights I also have no responsibility. They convened a grand jury, gagged my testimony and threw me in prison for 18 months. I now have case law where Senior Judge John Cummings (now retired) of Cabell County specifically states in his decision in the Ryan case that if a persons parental rights have been involuntarily terminated by the state that person has NO OBLIGATION TO PAY SUPPORT. Regardless they keep trying to rearrest me at 45 to 90 day stents in jail for the same offense even though I have served the maximum sentence by law for refusing to pay the support since the day it was court ordered. NOW to make matters even more complicated,,,after my divorce in 2001 I in 2003 was dating a girl that lived some 70 miles from my place of residence. I could only afford to see her every other week or so due to the long drive. I found out over time that she was seeing others when I was not around so I broke it off. Afterwards I learn she is pregnant but with no proof that it is mine. She swears it is mine however. When the child is born the hospital contacts me by phone and ask if I wish to come to the hospital and add my name to the childs birth certificate. I refused and informed the hospital staff that I wished to exercise my right under the SAFE HAVEN ACT to leave the child at the hospital and voluntarily relinquish all parental rights to the child and give the child up for adoption. According to WV State law either parent can exercise this right. The hospital then has the responsibility to contact the Dept. of Health and Human Resources to initiate the processes ,,,I have by law the right to remain anonymous throughout the entire process. Three years later in 2006 the Family Court of Wirt County, WV without a blood test proving my parenthood orders my name placed on the childs birth certificate and orders me to pay support for the child while completely ignoring my having exercised my rights under the Safe Haven Act. I appealed to the Circuit Court but they have also ignored my complaint,,stating that the law is the law,,,while yet ignoring the law. I have recently over the last 5 months filed 4 different motions to the Circuit Court of Wirt County and the court has failed to reply to even one of them. This morning the Sheriffs knock on my door at 5am here to arrest me on FELONY charges of failure to pay support for a minor. Once I told them my story they did not arrest me but told me to visit the magistrates office today and make bond. Ive had to fight my cases pro se (without an attorney) because I have not been gainfully employed since 2001. So these corrupt courts simply railroad a person because there is no lawyer to hold them accountable. Again I will probably do time for standing my ground against the corruption. I ASK THAT YOU PLEASE SHARE MY STORY TO ALL THAT YOU CAN,,SIMPLY TO RAISE A CONSCIOUSNESS IF NOTHING ELSE. THESE COURTS GET AWAY WITH ALL THAT THEY DO BECAUSE IT IS ALL KEPT SECRET AND BEHIND THE CLOSED DOORS OF THESE FAMILY COURTS. THANK YOU.
