WHY WE NEED A REFERUNDUM: Though some argue based on their political inclinations, I want to objectively look at the reasons why we need a referendum to amend some sections of our constitution, this are the reasons. - Article 203(2) Talks of not less than 15% of national revenue recently audited should be allocated to counties, should be changed to read NOT less than 45% or more to go to counties. - Article 43(1). Every person has a right to the highest attainable standard of health, which includes the. Right to health care services, this clause should be. Respected by marching functions and resources and not the current state where health is devolved without resources. - Article 179- Gives powers to governors to initiate and implement projects, a clause should be inserted to make them more accountable. - Article 190. Gives parliament to legislate to ensure counties have adequate support to enable them perform their functions, today, parliament has enacted legislations that goes against the constiturtion I.e bill that allows senators to sit in county development boards which is unconstitutional. - Article 174. Spells out objects of devolution, it strongly supports separation of power, this chapter should be used to give more power to Senators be UPPER house and have vetto powers to enable it discharge its manndate fully. - Article 89 on delimitation of boundaries should be ammended to reduce the number of constituencies(MPs), nominated MCAs, nominated senators, this will reduce the cost of service delivery, this should be read together with Article 98. - Article 119 on peoples petition to parliament should be given more life and not left to parliament to legislate, people must have direct role on. Petition. This and many other reasons makes me think it time we amend our constitution, Article 255/256/257 does not give timelines on when to do a referendum, let us objectively audit our constitution without tribal/party feelings.
