We should thank the AG and IGP for upstaging PRs Selangor imbroglio with their generous and liberal application of the Sedition Ordinance. Charging every man and his dog, including journalists and law professors such as Azmi Sharom, with such an archaic and implausible offence is just what we need to unify the opposition and middle classes to campaign against the Government. Todays Court of Appeal judgment in the TBH case, and the previous ruling by the same coram that struck down part of the Peaceful Assembly Act for unconstitutionality, are a reminder that the appellate courts are not a risk-free environment for the Government. Though they can block independent-minded judges such as Hishamudin Yunus J. and others from being elevated to the Federal Court, this only means that they are concentrated instead in the Court of Appeal. This makes sense if the Government wants to ensure that unfavourable judgments are ultimately overruled by the Federal Court. But guess which is the highest court to which the sedition prosecutions commenced in the Sessions Court can be appealed? Hint: its not the Federal Court.
