We won a motion in the NY Supreme Court (Queens) ordering the wife to vacate the house that was owned by our client before the marriage and denying her support until she vacates. She had unsuccessfully argued that her inclusion on a post-marriage amendment to an agreement between the our client and the other owner of this two family house should result in her having an ownership stake of half of our clients 50% share of the house. We prevailed, and even better, she must vacate within 60 days instead of at the end of the case which could take much longer to resolve. There are no children and the wife is a licensed realtor, plus she will receive support once she moves, so she will be fine. Getting my client his house back now, rather than much later, is the unusual victory, plus the time and money we saved him by this pre-trial motion versus litigating this matter at trial.
