Well, can i assume that the first installment payment from our judgement debtor will not be paid on Monday as per the Magistrates Court installment Order? Every time we get close to the date of something happening with the long winded bathroom renovation drama, I hear this song on the radio and it has become an omen that what we might expect to happen will not happen. https://youtube/watch?v=9MDTCF1dp28 First just before the first VCAT Hearing, then again before the second VCAT hearing, then just before we received the letter from the Sheriffs Office regarding the results of the warrant to seize property and now today, just before the installment order. We will keep pushing through though and will take it right to the end, including enforcing a bankruptcy if required. Hopefully though under the Judgment Debt Recovery Act we can continue to enforce the order and hopefully if he continues to willfully default then push to have him imprisoned. As a result of the omen though, I have begun preparing documents so they will be ready to send to the lawyers on Tuesday morning so that they can deal with him. Is he that uneducated that he cannot understand that failure to pay the first installment order under the Judgment Deb Recovery Act will mean that our scaled legal fees will be added to the sum he has to pay on top of the judgement debt? Also by us now hiring a lawyer we will take enforcement to the end. If he also fails to pay on Monday I will also be writing a letter to the Victorian Building Authority to ensure that if he is prosecuted for the works he carried out on our property, the prosecution might be able to put forth to the judge that this person has refused to take any liability for his actions, including failing to pay an installment order under the Judgment Debt Recovery Act and has not shown any remorse for what he has done and hence to take a more serious approach if they fine him. I really wish they would change the rules to allow imprisonment of someone rather than just fines. But hey, lets just see if this continual omen comes true.
