What is the substance of JPC report on 2G? The JPC headed by the Chairman Sri P.C.Chako. It was constituted on 4.3.2011 and it had 30 members- 20 from Loksaba and 10 from Rajya saba. JPC was asked to give the report before the end of Monsoon session 2011. It was given five extensions and had 57 sittings and debated for over 155 hours. The draft report considered on 27.9.2013. 16 supported the report and 11 opposed. 3 members were absent. The substance of the report are as follows: 1) There is no cabinet decision to enhance the entry fee. 2) Auction has neither been advocated by TRAI nor any policy decision to that. 3) Presumptive loss theory is untenable- S Tel offer, 2G comparison with 3G, equity infusion and the loss theory are untenable. 4) Decision to have cut off policy is transparent. But advancing the cut off date is not fair. 5) There is no proper mechanism in Department of Telecom to screen the ineligible applicants. 6) No criminality in equity infusion as FDI is necessary for the Telecom Sector. 7) Amending the press release by DOT is the problem which is however subject matter of CBI investigation and sub judice. 8)Telecom commission meeting and its decision even if some members do not attend has the sanctity. And allegations against this is ill founded. 9) Mr Raja misled the PM telling that on the FCFS policy and his assurance to the PM belied. 10) There is a procedural deviation in the application of FCFS criteria in the allotment and sanction of spectrum and licence. 11) The CAG should look into the benefits accrued by the policy while computing the loss. 12) No record to say that proposal for enhancement of entry fee put up to Mr A.Raja. 13) No record to say that Sri DS Mathur, Secy DOT had any differences with Mr A.Raja. 14) Meetings between Telecom Minister (Mr Raja) and Finance Minister (Mr P.Chidambaram) are only to carry forward the decisions of the cabinet in 2003. In 2G, the entry fee and the 1.76 loss are the main allegations on 2G spectrum- that rocked the country. But both these allegations have been demolished by the JPC through various statements of the former Secretaries, the Supreme Court Opinion on Presidential Reference and the Report of TRAI made to CBI on laters request. Now according to JPC report, no loss in 2G and no fault in charging the entry fee at 2001 rate and only thing is that Mr Raja misled the PM, belied the assurances given, the DOT deviated in adopting the criteria of FCFS policy and the advancement of cut off date is unfair though the decision to have cut off date is transparent.
