When a hammer, screwdriver or anything else is called a weapon by a judge, he is using his legal fiction authority to assign a new meaning to a word and the word becomes more real than the thing it is supposed to represent. A weapon is not a weapon unless it is used as a weapon. Even if it is a gun, which can also be used as a hammer. This is the problem with legal fiction - they take reality, make it into words and only talk about the words - now how stupid is that? Pretty elementary huh?
