YOU BE THE JUDGE: Student is transferring into a school district from another district. The parents ask the school to not implement the last districts IEP. A review of the records show that, several months earlier, the parents orally asked the former district to stop services, but that the district informed them that an oral request wasnt sufficient -- it had to be in writing. No written withdrawal of consent was in the records. While parent agreed for a re-evaluation in the new district, she never returned the consent to evaluate form. The new district then implemented the old districts IEP. Several months later, the parent sent a letter to the district to terminate special education services, at which point the services ceased. Parent files a state complaint, saying they never agreed to start services in this district. What is the State Dept of Eds decision? Did the district err in providing services until the parents withdrawal of consent letter was sent?
