YOUNG GUYANESE NATIONAL ENTREPRENEUR’S FURNITURE FACTORY EXPROPRIATED BY GUANGDONG FOSHAN CHINESE COURT WITHOUTCOMPENSATION This is an incredible Chinese nightmare happening to young Guyanese entrepreneur expatriated to China sine 2009. Mr Blackett Ian is the first independent entrepreneur from Guyana to have invested in China ,by establishing a self designed upholstery furniture factory to supply his furniture stores in Guadeloupe and Martinique french west indies. Polyglot,Mr Blackett speaks fluently cantonese and has notable buisiness skills for have been raised in the Chinese community of French Guyana. However his knowledge and skills could not prevent him to fall into this chinese nightmare devoid of reason.Traveling on a buisiness visa in China he registred at the Guyana’s embassy and detailed his intention in China for assistance and protection. With his feasability project in hand he rented a factory in Canton Foshan Jiujiang township situated in an industrial area specialised in the same activities as his plan..Since his establishment in the premisses he strives to obtain necessary administrative authorizations to Produce,while the Government of Foshan municipality authorizes him to invest without his knowledge in a building without construction permit and security clearnce to be used. While this situation is hidden by the landlord and the locale authorithies Mr Blackett invested in his first store in the international center shunde lecong exposing his achievements for the international export market .His furnitures meets sucess with orders for local and international market .At the suprise of all the same local authorities , stopped the factory for default of operating license encreasing the investment risk and putting workers on the bench.. However after four months of tractations the local goverment delivers a buisinesse license without the buisiness scope of manufacturing furniture, only design furniture was allowed. Exasperated by the irrational situation Mr Blackett turned to the Guyana Embassy in Beijing for assistance, finally in august 2010 the government of Foshan rectify the buisiness license after the intervention of the Embassy but the local jiujiang government warned Mr. Blackett and delivered him a decision of the council board forbidding new furniture production company.The local jiujiang government confirmed that the factory rented by Mr Blackett is not within fire regulations and construction standards , therfore the building can not be used. Mr Blackett claims that this situation could have been avoid by the local government before they authorized him to invest in the building. He insisted that the delayed of approval of his right buisiness license, an abnormal situation is only profitable to the factory’s ownwer who continues to collect rent as time goes on for a factory that finally can not be used. Mr Blackett had already invested over $160,000 USD in the factory at that time . Continuing using the building puts Mr Blackett’s buisiness at risk to be stopped again by the government .Therfore Mr Blackett was unable to face this financial situation and climate of insecurity for his investment ,stopped paying rent and filed case against the the owner responsable for the building’s illegale situation. The procedures lasts for over two years while the factory, equipments, furniture and models,the designs are seized by the court to garentie the execution of contract signed with the owner.The court confirms that Mr Blackett’s buisiness license is in accordance with the law and the building is in violation of the construction laws , therfore can not be used. The contract with the owner is also pronounced null and void .Mr Blackett says with conviction that the decision of the chinese court expropriates his buisiness’s right to used the building granted by the buisiness license to operate in it ,this in accordance with China – Guyana protection of investments agreement. The buisiness license to operate and all operations related to it are investments that should be protected.The seizure of the investments,the denial of the right to use ,enjoyment , maintenance and operating the buisiness and its equipements expropriates the investments without a right to a judicial revue and evaluation of the investments and it loses.Mr Blackett claims he has lost the controle of his investment since the gouverment has authorised him to invest in the building putting him in a non profitable and illicite situation which is contairy to the principals of the bilateral agreement between the Government of Guyana and the Government of the Peoples republic of China on the Promotion and Protection of Investments . This under the watch of the Government of Guyana helpless and inert to this injustice . Mr Blackett still do not have the right to an evaluation and and prompte revue of his case for compensation in accordance with the principles of the bilateral treaty signed between the Government of Guyana and the Government of the Peoples republic of China on the Promotion and Protection of Investments . Mr Blackett has already payed more than $ 29,500 USD of justice fees to the Chinese court without an analysis of the rights of all his investment .Since his cases are pending by the courts and has no notified date for trial he can not be home with his family and reletives since march 2009. His visa is irregulary in application for renewal during national holidays preventing him to leave China and be back during long Chinese national holidays. Unemployed since his investment can not be use he is without financial resources since 2010. The current situation leeds to a slow financial asphixiation and social isolment.. Mr Blackett claims that Guyana’s ministry of foireign affairs and it’s embassy in Beijing tried in vain to find a solution to his problems but the Chinese Goverment does not respond to their correspondences. Mr Blackett is convinced that both goverments are aware of this situation and has choosen to let the situation rot to avoid any responsability in Mr Blackett’s financial prejudice. China – Guyana protection of investments agreement and diplomacy seems to be applied in one way.This situation is clearly inequitable and inhumaine while Chinese nationals are welcomed and protected by Guyana’s goverment. How much should Mr Blackett and his family endure in the total indifference of all Guyanese for the respect and application of the bilateral agreement between the Government of Guyana and the Government of the Peoples republic of China on the Promotion and Protection of Investments?
